1. Who you are contracting with

The CineMatch AI service ("Service") is provided by Nitish ("we", "us", "our"). By using the Service you enter into an agreement with Nitish.

2. Acceptance

By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

3. The Service

CineMatch AI provides AI-generated movie and show recommendations, watchlist management, and related features.

4. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it updated. You must be of legal age in your jurisdiction.

5. Acceptable use

You must not misuse the Service, including by: (a) using it unlawfully or fraudulently; (b) sending spam; (c) infringing intellectual property; (d) interfering with security (malware, probing, scraping); (e) reverse engineering, reselling, or redistributing the Service; or (f) circumventing technical limits.

6. AI outputs

The Service uses AI models to generate recommendations and other outputs. Outputs may be inaccurate, incomplete, or unsuitable for your purpose. You are responsible for your prompts, how you use outputs, verifying accuracy, and having the rights to any content you submit. Do not use outputs for regulated professional advice without independent oversight. Prohibited content includes illegal material, hate speech, deepfakes, malware, and jailbreak attempts. We may filter, refuse, or remove outputs and content and may suspend accounts for repeated or serious violations.

7. Intellectual property

We retain all rights, title, and interest in the Service, including software, documentation, and branding. You receive a limited, non-exclusive, non-transferable right to use the Service within your plan.

8. User content

You retain ownership of content you submit. You grant us a limited license to host and process your content solely to provide the Service. We may remove content that violates these Terms.

9. Payments, subscriptions, refunds and tax

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing frequency, tax, cancellations, and refunds are governed by Paddle's Buyer Terms. See also our Refund Policy.

10. Suspension and termination

We may suspend or terminate access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends.

11. Service level and warranties

The Service is provided "as is". We do not guarantee that it will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

12. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the amounts you paid to Paddle for the Service in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Indemnity

You will indemnify us against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

14. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Nitish operates, without regard to conflict-of-law rules.
